The State of New Jersey Takes Action Against Ocean Grove for Sunday Beach Closures
The New Jersey Department of Environmental Protection (NJDEP) has recently taken legal action against the Jersey Shore town of Ocean Grove. On September 14, the NJDEP served a Notice of Violation to the Christian seaside community for their policy of closing the beach for a few hours on seasonal Sundays. This move has sparked controversy and raised questions about religious freedom and fairness.
The Notice of Violation was sent to Ocean Grove Camp Meeting Association Director of Operations Steve Columbo. The NJDEP gave the association 10 days to respond and recommended engaging in compliance discussions with the Bureau of Coastal and Land Use Compliance & Enforcement to resolve the matter.
This Notice of Violation comes after Ocean Grove received a warning letter on August 10, 2023, for non-compliance with the state’s policy on public access to the beach and wet sand. The town has kept its beach closed on Sunday mornings until noon for generations to allow residents to attend church and engage in religious worship.
Ocean Grove Camp Meeting Association President Michael Badger responded to the state’s action, expressing disappointment but willingness to continue discussions with the NJDEP. Badger also pointed out a potential double standard, as a neighboring community, Asbury Park, has been allowed to close parallel access to the beach for a music festival for several days.
Badger questioned the fairness of this double standard, stating that Asbury Park was permitted longer beach closures for a non-religious event while Ocean Grove is being criticized for its short closure on Sundays. He also raised concerns about the NJDEP only enforcing regulations in response to complaints, suggesting that the complaints against Ocean Grove may be fueled by anti-Christian sentiments.
The NJDEP has stated that it is evaluating reports of beach access closures in Point Pleasant and will take appropriate action where needed. Badger confirmed that the NJDEP will be investigating Jenkinson’s, a beachside venue in Point Pleasant.
Despite the controversy and opposition, Ocean Grove remains firm in its belief that the Sunday morning beach closures are essential for religious observation and maintaining the historic charm of the town. The community values the quieter and less stressful environment created by the closures.
