Motion to Depose Plaintiff in Traffic Collision Suit Granted for Schwarzenegger’s Son

A court ruling has favored the son of actor and former Governor Arnold Schwarzenegger, following a deposition order for one of the plaintiffs involved in a consolidated lawsuit. The lawsuit involves three individuals who claim to have been injured in a car accident involving Schwarzenegger’s son in Brentwood in 2020.

Los Angeles Superior Court Judge Anne Hwang is overseeing the combined cases brought by Maryam Pirian, Manouchehr Pirian, and Gad Kakanyisa. Christopher Schwarzenegger’s attorneys previously filed court documents indicating that Kakanyisa had been notified to appear for a deposition on June 1, and initially did not object to the date. However, within 48 hours, he claimed he was unavailable.

Last Friday, Judge Hwang ordered Kakanyisa to attend a deposition within the next 30 days. Additionally, she fined the plaintiff $1,545 in attorneys’ fees and costs.

“The court determines that the plaintiff failed to appear for a properly scheduled deposition without serving a valid objection,” stated Hwang.

According to Schwarzenegger’s attorneys, Kakanyisa did not respond to inquiries regarding rescheduling the deposition or explain his failure to attend the June 1 session.

“This lack of communication with defense counsel is unreasonable, causing unnecessary delays and expenses,” argued Schwarzenegger’s lawyers in court filings. They initially requested a fine of around $2,330, but the judge deemed it excessive.

The Pirians, both 78 years old, claim that their vehicle was struck by Schwarzenegger’s 25-year-old son’s vehicle while they were driving south on Carmelina Avenue at Sunset Boulevard on October 30, 2020. Kakanyisa, 52, was driving a second car that was also allegedly hit by the actor’s son. All three plaintiffs have named both Schwarzeneggers and the actor’s company, Oak Productions Inc., as defendants in their lawsuit.

The Pirian-Kakanyisa lawsuit is separate from another lawsuit filed in Los Angeles Superior Court by Saam Takaloo, 34, against another of Schwarzenegger’s sons, actor and fitness model Joseph Baena. Takaloo claims to have been injured in a car accident involving Baena on the southbound San Diego (405) Freeway in Culver City on April 5, 2021. The same defendants are named in Takaloo’s lawsuit.

Baena, 25, is Schwarzenegger’s son with his former housekeeper, Mildred Baena, following an alleged affair that led to the actor’s former wife, Maria Shriver, filing for divorce in 2011 when the affair became public. Baena participated in the 31st season of “Dancing With the Stars” in 2022 as a contestant.
