Live Nation Files Motion to Dismiss Lawsuit by Woman Injured at Rolling Stones Concert

Live Nation Worldwide Inc. is seeking to have itself removed as a defendant in a lawsuit filed by a woman who claims she was forcefully pushed into bushes by a group of concertgoers while leaving a Rolling Stones concert at Sofi Stadium in 2021.

In court documents filed with Torrance Superior Court Judge Deirdre Hill, Live Nation lawyers argue that the plaintiff assumed the risks associated with attending the concert, therefore absolving the company of any legal liability.

While reserving the right to present additional defenses if deemed necessary, Live Nation’s attorneys request that Diana Hayden’s complaint be dismissed and that the company be released from any responsibility, stating “plaintiff voluntarily assumed the risks and plaintiff’s assumption of those risks with a knowledge of the magnitude of them was the sole and legal cause of the accident and of the injuries and damages sustained, if any.”

In addition to Live Nation, Hayden also includes SoFi Stadium as a defendant in her lawsuit, citing negligence and premises liability. According to her complaint, Hayden and her daughter left the Rolling Stones concert early in an attempt to avoid the crowd. As they walked towards their car, they encountered a large group of fans being directed by stadium staff through temporary guard rails. These guard rails collapsed as people rushed to their vehicles, resulting in Hayden being violently thrown into nearby bushes.

The lawsuit asserts that had the concertgoers been directed in a safer manner and the guard rails been more secure, Hayden would not have been knocked down. Furthermore, it alleges that there was insufficient security staff present at the event.
