Jack Daniel’s has been given a new chance to win a trademark dispute against the makers of dog toy Bad Spaniels following a unanimous Supreme Court decision. In an opinion for the court, Justice Elena Kagan playfully noted: “This case is about dog toys and whiskey, two items seldom appearing in the same sentence.” Part of VIP Products’ Silly Squeakers line of chew toys that mimic drink bottles, the toy proclaims “The Old No. 2 on Your Tennessee Carpet”, while the original bears the words “Old No. 7 brand” and “Tennessee Sour Mash Whiskey.” The Jack Daniel’s lawyers argued that the toy misleads customers with disparaging terms.
