Investigation Underway: Legal Firms Suspected of Coercively Including Themselves in Elderly Individuals’ Wills

Obtaining a refund can be an arduous task once someone has engaged the services of an unregulated legal firm. In cases where a regulated solicitor delivers subpar service, their client can lodge a complaint with the Legal Ombudsman, who can order the solicitor to compensate the client. However, customers of unregulated firms do not have this option.

The scrutiny of the CMA extends to firms that offer prepaid funeral plans. These plans, which have gained popularity, pledge to cover the legal fees associated with estate administration. The issue lies in the fact that the size and complexity of an estate can change over time, creating a pricing dilemma based on substantial uncertainty. Mr. Garrett alluded to this concern.

The CMA has expressed worry about the tactics employed by firms offering prepaid probate plans, particularly when targeting older and vulnerable individuals through pressure selling techniques.

Sills and Betteridge Solicitors’ representative, Anna O’Mara, shared the experience of encountering clients who have fallen victim to unregulated firms. While the allure of getting things done quickly may be enticing, there is no means of recourse in such cases.

The CMA has also flagged concerns regarding legal firms that offer “online divorces” for misleading pricing claims and a subpar service that involves using incorrect forms, providing inaccurate details, and submitting court papers late, potentially jeopardizing the divorce process.

Since 2018, couples have been able to apply for a divorce online through the government website, with 96% of all divorce applications now being made digitally, as reported by the Ministry of Justice. The introduction of “no fault” divorces in the previous year has made the process easier and more accessible for couples.

Gary Rycroft of Joseph A Jones & Co Solicitors expressed his belief that it was inevitable for untrustworthy providers to enter the market once divorce became more convenient and widely available.
