An Orange County jail inmate has been sentenced to six years in prison for his involvement in a brutal beating that occurred while he was in custody.
Meet Gabriel Marcos Guerrero, a 24-year-old who pleaded guilty on May 19 to a felony charge of assault with force likely to cause great bodily injury. He received an additional sentencing enhancement due to the severity of the injuries inflicted on the victim, David Montoya. The incident took place on October 13, 2019, at the Theo Lacy Jail in Orange, as detailed in court records.
Guerrero’s co-defendants in this case, Johnny Jose Perez (40) and Javier Tovar (34), were found guilty on April 4 of charges related to mayhem and assault with force likely to produce great bodily injury. A jury determined that the victim suffered serious injuries, leading to an enhancement in their sentencing.
However, it is worth noting that the attempted murder charges against the defendants were dismissed on March 30, as revealed by court records.
Perez, who played a significant role in the incident, received a sentence of 16 years in prison.
As for Tovar, he was sentenced to 11 years in prison, with credit given for the 1,200 days he has already spent in custody.
Meanwhile, Francisco Javier Amaya, another co-defendant, pleaded guilty on March 3 and received a 10-year prison sentence.
It is interesting to note that Tovar had a prior criminal history. In August 2007, he pleaded guilty to various offenses, including assaulting a peace officer or firefighter with a weapon, leading police on a chase, car theft, possessing a firearm while on probation, possession of a firearm in a school zone, and unlawful possession of a concealed firearm in a vehicle. All these crimes were categorized as felonies.
