High-ranking DOJ Official Was Ready to Utilize Insurrection Act to Remain in Office

Jeffrey Clark, a former high-ranking official in the Justice Department during Donald Trump’s presidency, was allegedly willing to use the Insurrection Act to retain power despite Trump’s defeat in the 2020 presidential election, as revealed by a federal indictment against Trump. The indictment uncovers a shocking exchange between Clark (referred to as Co-Conspirator 4) and deputy White House counsel Patrick Philbin on January 3, 2021. Philbin had previously cautioned Clark in December about leaving the White House on January 20th, emphasizing that there was no option for him to remain. Philbin reiterated his point on January 3, attempting to dissuade Clark from assuming the role of acting attorney general under a fraudulent Trump presidency by warning of potential riots in major cities across the United States if Trump attempted to cling to power without evidence of widespread election fraud. In response, Clark mentioned the Insurrection Act as a justification for such actions. The Insurrection Act, established in 1792, grants the president the authority to deploy the military domestically in specific situations, such as suppressing civil disorder or rebellion.

According to the indictment, Clark, who worked on civil matters, collaborated with the defendant in an attempt to manipulate the Justice Department into initiating baseless investigations into election crimes and influencing state legislatures with knowingly false claims of election fraud.
