Hearing Scheduled for Protective Order in Election Fraud Case Involving Trump

In relation to the criminal election case against Trump, a federal judge, Tanya Chutkan, has scheduled a hearing for Friday morning. This comes after Trump’s lawyers expressed their desire to postpone the session until early next week, despite Judge Chutkan’s request for dates on or before Friday. The prosecutors from the office of special counsel Jack Smith have made themselves available for the hearing on Wednesday, Thursday, or Friday at the U.S. District Court in Washington, D.C.

During the session, Judge Chutkan will address Smith’s request to bar Trump from publicly disclosing certain evidence collected during the criminal investigation. Trump, who will not be present at the hearing, is facing four felony charges related to his attempt to overturn his loss in the 2020 election to President Joe Biden.

Notably, just before the scheduling of the hearing for Friday at 10 a.m., Trump criticized Judge Chutkan on social media. He pointed out that she was appointed to the judiciary by former President Barack Obama and alleged that she had a conflict of interest in the case.

Earlier on Tuesday, Trump’s lawyers and Smith’s prosecutors jointly informed the judge of their availability for the hearing. The notice revealed that Trump wants both of his lawyers, John Lauro and Todd Blanche, to be present. However, Blanche is unavailable on Thursday due to his involvement in a court proceeding in another case against Trump by the Special Counsel in federal court for the Southern District of Florida. On the other hand, Lauro is available on Thursday, preferably in the afternoon. In light of losing Friday as an option, Trump’s legal team respectfully requested a hearing on Monday (after 12:00 p.m.) or Tuesday (for the entire day), allowing for both Blanche and Lauro to be present. The notice did not provide specific reasons for why Friday was not feasible or why they could not meet on Wednesday.

From a historical perspective, Trump has a consistent track record of prolonging and complicating legal proceedings through procedural tactics and appeals. His team has already shown an inclination to adopt this strategy in his current case. Trump publicly expressed his desire to have the case transferred out of the District of Columbia and to remove Judge Chutkan from the bench, claiming that he would not receive a fair trial with her presiding.

Interestingly, Chutkan had previously denied Lauro’s attempt to extend the deadline for responding to the protective order request. Another criminal case in Florida, brought by Smith, accuses Trump of retaining classified government records, attempting to conceal them from federal officials, and destroying video evidence that captured the movement of these documents within his Mar-a-Lago Club in Palm Beach. Trump has pleaded not guilty in both federal criminal cases.

Moreover, he is facing separate criminal charges in New York state court in Manhattan for falsifying business records in connection to a 2016 hush money payment made to porn star Stormy Daniels.
