A former employee of Ross Dress for Less Inc. has successfully resolved her gender discrimination lawsuit against the company. The employee claimed that while she was on maternity leave in 2022, she received an unexpected automated text message from management asking her to choose the primary reason for her resignation.
Lisette Mayorga filed her lawsuit in the Los Angeles Superior Court, alleging not only gender discrimination, but also retaliation, failure to accommodate, and failure to engage in the interactive process. The terms of the settlement were not disclosed in the notice filed by her attorney with Judge Elaine Lu.
In August 2021, Mayorga was hired as a retail associate. In December of the same year, she informed her store manager about her pregnancy, to which the manager responded, “Take it easy, you’re pregnant,” according to the lawsuit.
In February 2022, Mayorga informed the assistant store manager that she would be going on maternity leave, expecting to return to her job eventually. However, during her time off, she received an automated text message from management thanking her for her contribution and asking her to select the primary reason for her resignation, according to the lawsuit.
Upon receiving the text, Mayorga was shocked. The store manager later informed her that she had been terminated and would need to reapply. Mayorga submitted her application and followed up four times, but was never rehired, as stated in the lawsuit.
