A revolutionary legislation in Illinois has become the pioneering law in the nation, aimed at safeguarding the earnings of children involved in social media influencing or featured in their parents’ online content.
Governor JB Pritzker of Illinois signed this bill into law on August 11. Commencing from July 1, 2024, children under 16 years of age who engage in social media influencing or appear in their parents’ content will be entitled to a percentage of the earnings based on their level of involvement.
These earnings must be placed in a trust until the child reaches the age of 18; otherwise, the child has the right to take legal action in accordance with this law.
Shreya Nallamothu, a 15-year-old who spotted the need to protect children aspiring to online stardom, is credited with championing this legislation, according to the Associated Press. She shared her idea with State Senator David Koehler, who later proposed the bill.
“I realized that there’s a lot of exploitation that can happen within the world of ‘kidfluencing,'” Nallamothu told the Associated Press. “And I realized that there was absolutely zero legislation in place to protect them.”
Koehler anticipates that Illinois will not be the only state to enact such a law. “I think you’ll see other states following us on this,” Koehler stated to Teen Vogue.
Meanwhile, the state of Washington is also contemplating a similar legislation, which has been pending in the state House Committee since February.
