Washington — The former chairman of the Proud Boys is scheduled to be sentenced on Tuesday for a series of felonies, including seditious conspiracy, that are connected to the attack on the U.S. Capitol on January 6, 2021.
The sentencing was delayed previously due to the illness of U.S. District Court Judge Timothy Kelly.
Henry “Enrique” Tarrio has been in custody since his arrest in 2021 and was convicted earlier this year by a jury in Washington, D.C. on several charges, including seditious conspiracy. Although the jury did not convict Tarrio on all counts, he was found guilty of being the “primary organizer” of the conspiracy. Prosecutors described him as using his influential position to endorse and incite violence in others, stating that he acted as a general rather than a soldier.
Tarrio’s co-defendant, Ethan Nordean, was sentenced to 18 years in prison last week.
Leading up to the 2020 presidential election, Tarrio posted on social media and in message groups, discussing a “civil war” and making threats of violence. As January 6 approached, he continued to promote the idea of a revolt. On the day of the riot, Tarrio’s co-defendants, along with other members of the Proud Boys, marched towards the Capitol, clashed with law enforcement, and eventually breached the building where Congress was certifying President Biden’s victory. Tarrio himself was not present at the Capitol during the attack, but his role as the primary organizer was still acknowledged by prosecutors.
Tarrio’s social media posts during the riot, stating “Make no mistake, we did this,” were presented as evidence during the trial.
Throughout the trial, defense attorneys attempted to separate the defendants’ rhetoric from the events of January 6 and, in some cases, placed partial blame on then-President Donald Trump for the violence that occurred.
This sentencing hearing will be the final proceeding in the Proud Boys case for Judge Timothy Kelly, who has imposed varied sentences over the past week. The judge declined to heavily consider terrorism-related enhancements requested by prosecutors, but ultimately handed down significant sentences.
