A former finance and insurance manager has filed a lawsuit against John Jones Chevrolet-Buick of Corydon, an Indiana dealership, alleging wrongful termination, retaliation, and sex discrimination. Mary Zipp, the plaintiff, seeks damages for mental anguish, lost wages, and benefits.
According to Zipp’s lawsuit, she endured severe and pervasive discrimination and harassment, which created an intimidating and hostile working environment. The dealership, in response, claimed that Zipp was fired due to a documented pattern of tardiness, absenteeism, and failure to meet attendance expectations.
In October 2020, Zipp was hired as the dealership’s only F&I employee. She received three disciplinary reports for punctuality issues and had a high number of late arrivals and unexcused absences. Given the importance of punctuality and attendance for F&I managers, the dealership stated that such shortcomings could negatively impact its overall efficiency.
Zipp’s lawsuit also accuses male employees of sending her unwanted sexual advances, sexually inappropriate comments, photographs, memes, and a video within group chats. The suit includes quotes from a sales manager and asserts that Zipp was suspended without pay after reporting the behavior to the store’s vice president. The vice president allegedly defended the sales manager’s actions, claiming they were financially beneficial for the company.
Furthermore, Zipp claims that the sales manager showed her a screenshot from a video of him masturbating in the company bathroom. Only after Zipp reported the incident to the vice president was the sales manager terminated for “gross misconduct.”
The dealership’s alleged discriminatory practices involved clothing requirements, with male staff being told to wear dealership-branded clothes while female staff were instructed to wear form-fitting dresses or pants. Zipp also asserts that she was paid less than her male counterparts for similar work, though the dealership denies that any men were performing such duties.
In response to the lawsuit, a defense lawyer for John Jones Chevrolet-Buick stated that it lacks merit and that the dealership will vigorously contest it.
