Federal Judge Poised to Set Trial Date for Trump Election Case

A federal judge is expected to schedule the start date for former President Donald Trump’s criminal trial on charges of attempting to overturn the 2020 election results and retain power. The trial, brought by Special Counsel Jack Smith in Washington, D.C., is one of four criminal cases that Trump currently faces, with this one addressing his broader attempt to reverse his loss to Joe Biden. Despite facing state criminal charges in Georgia, Trump is not expected to attend Monday’s hearing. Trump has previously criticized U.S. District Judge Tanya Chutkan, claiming bias, and portrayed all four prosecutions as politically motivated. Smith’s office has proposed a trial start date of January 2, 2024, while Trump’s lawyers have requested a delay until April 2026.

In response to the proposed trial date, Trump’s lawyers argue that the public interest lies in justice and a fair trial, rather than a rush to judgment. They point out the extensive amount of evidence, totaling 11.5 million pages, and express the need for sufficient time to review it. Prosecutors counter by stating that much of the evidence consists of records Trump had access to, such as his own tweets and campaign statements, as well as public records released by a House select committee. Trump and his legal team also face the challenge of scheduling court dates for his other three upcoming criminal trials while he campaigns for a return to the White House.

In Georgia, District Attorney Fani Willis has requested a trial date of March 4, 2024, for the state charges against Trump, including racketeering. A judge has set a trial date of October 23 for Trump co-defendant Kenneth Chesebro, who requested a speedy trial. Sidney Powell, another co-defendant and attorney who advised Trump, has also requested a speedy trial. Trump is already scheduled to be on trial in New York on March 25, 2024, for separate state charges, and in Florida on May 20, 2024, for federal charges related to retaining classified records after leaving the White House and obstructing justice. He has pleaded not guilty to all charges.

This will be the second time Trump’s lawyers appear before Judge Chutkan to discuss pre-trial logistics. During the last hearing, Chutkan warned Trump to refrain from posting inflammatory statements online about witnesses or others involved in the case.
