Plaintiff Alleging Teacher Tied Grades to Sex Ordered to Undergo Mental Examination by Judge

A judge has granted a request for a mental examination of a man in his mid-30s who claims to have been sexually molested by a female teacher from the Paramount Unified School District over 20 years ago. The teacher allegedly told him that he had to submit to her advances in order to receive good grades.

Los Angeles Superior Court Judge Maurice A. Leiter approved the district’s motion to compel a psychological evaluation of the plaintiff, identified as John GD Doe, born in 1986.

“Since the plaintiff is claiming emotional distress damages, his mental condition is relevant to this case. Therefore, an independent mental examination is justified,” wrote Leiter.

The mental assessment will be conducted over two days by psychologist Julie M. Brovko.

“Dr. Brovko is not allowed to inquire about the plaintiff’s sexual history with anyone other than the accused perpetrator,” specified Leiter.

The plaintiff alleges that the PUSD district negligently supervised and retained teacher Gillian Melba Duran, who was his language arts teacher at Alondra Middle School. According to court documents, Duran sexually abused him from 2001-02. Duran has already been convicted and is not a defendant in the current lawsuit.

The lawsuit filed in February 2022 states, “Using her position as a Paramount Unified School District teacher, Gillian Duran would regularly sexually groom the plaintiff while he was her eighth-grade student.”

The suit alleges that Duran would frequently touch the 14-year-old boy inappropriately in front of other students by massaging his shoulders. In seclusion, she would express her affection for him. Additionally, Duran would drive the plaintiff alone in her car, molesting him and providing him with alcohol at her home.

The suit further claims that Duran abused Doe in her classroom during lunch hours and that the school officials ignored her behavior throughout his entire eighth-grade year, despite her multiple absences from faculty meetings and other required events.

Duran targeted Doe, an immigrant who did not live with his biological parents and relied on public transportation for school, making him vulnerable, according to the lawsuit.

The suit states, “He was shocked by his teacher’s sexual advances during their first ride home, but she made it clear that his grades would be affected by his compliance.” Doe later reported the abuses to his father, who then contacted the police. Duran was arrested, charged with 12 counts of child sexual abuse, and subsequently sentenced to jail. Upon release, she was required to register as a convicted sex offender.
