Delta Settlement to Distribute Refunds for Covid-Related Cancellations

  • If you had a Delta flight canceled early in the Covid-19 pandemic, you may finally receive a refund.
  • This is a result of a recent settlement in a class-action lawsuit that Delta has agreed to.
  • Insider provides a detailed breakdown of the qualifications for a refund and the steps to take.

Anyone who had plans to fly at the start of 2020 will recall the travel nightmare that unfolded in March when the Covid-19 pandemic resulted in numerous canceled and disrupted flights.

Now, certain Delta Air Lines passengers who had their flights canceled during the first year of the pandemic may be eligible for compensation due to a settlement in a class-action lawsuit (Dusko v. Delta Air Lines) that the company has agreed to. While a court decision is pending, initial approval for the settlement has been granted, as noted on the dedicated website for the class action.

According to the website, Delta violated its contracts of carriage with ticketholders by refusing refunds for flights canceled during the pandemic and instead offering credits for future travel. Delta has denied the allegations but agreed to settle in order to avoid further litigation.

A representative for Delta did not provide a comment in response to Insider’s request, which was made outside regular working hours.

Are you eligible for a refund?

To be eligible, you must be a US citizen who received credit (not cash) for a non-refundable Delta flight that was canceled between March 1, 2020, and April 30, 2021. Additionally, you must have requested a refund but have not received one, and you must have unused or partially unused credit as of January 13, 2023. Delta employees, their family members, judges involved with the case, and their family members are not eligible for a refund.

What can you receive from the settlement?

Passengers who meet the criteria mentioned above can choose to request a cash refund or credit for each eligible ticket. The cash refund will be equal to the original ticket amount. The credit refund will be equal to the amount of unused credit plus 7% interest. The issued credit will be valid for one year, according to the website.

How to request a refund if you are eligible:

If you qualify, you must complete an online claim form. Alternatively, if you have already received an email informing you of your eligibility, you can find a link to the claim form in the email. Qualifying passengers can also opt to fill out a physical claim form and mail it in. All claim forms must be submitted by September 15, 2023. The court is scheduled to hold a hearing on October 5 to determine the approval of the settlement. Refunds will only be issued once any appeals are resolved, so passengers are advised to be patient, as mentioned on the website.
