Biden Allegedly Manipulating Data at the Border

During Joe Biden’s vice presidency, the Obama administration made changes to how the Department of Homeland Security (DHS) counted deportations. These changes aimed to create the appearance of enforcing immigration law while negotiating a mass amnesty bill.

The administration inflated deportation numbers by including recent unlawful border crossers who were returned after being in U.S. Border Patrol custody. This skewed the count, which historically only included illegal aliens removed by U.S. Immigration and Customs Enforcement.

Unfortunately, the Biden administration is now manipulating the data on unlawful entries. They do this to make the numbers appear smaller and deceive the American people and the media into thinking their border security strategy is effective.

According to the administration, “border encounters remain low” since Title 42 ended on May 11. However, this is disinformation. The humanitarian and security crisis at the southern border continues, and the overall problem of illegal immigration is even worse than the reported border numbers suggest.

Here is the reality that the Biden administration is concealing and the media is failing to accurately report.

First, it is important to understand that when DHS talks about unlawful entries between ports of entry being down, they are only referring to illegal aliens apprehended by Border Patrol agents. They intentionally exclude the number of aliens found inadmissible at ports of entry by Office of Field Operations officers. However, under U.S. immigration law, it doesn’t matter which border officers intercept the illegal aliens attempting to enter the U.S., as they are all in violation of the same provision of law.

However, the Biden administration has a different perspective and considers only illegal aliens “encountered” by Border Patrol agents to be breaking the law. Their new border strategy, announced in January, actually encourages illegal aliens to show up at ports of entry after scheduling an appointment through the CBP One app.

More than 99% of illegal aliens who used the app between January and April were allowed entry despite not having a visa. Instead of discouraging illegal immigration, this process diverts it to a controlled environment. This helps the administration avoid negative optics of a large influx of illegal aliens crossing the border. However, the end result is still the same—mass releases of illegal aliens into American communities.

In May 2023, there were a combined 204,561 “encounters,” which is only slightly lower than the approximately 211,000 in April and the second-highest number for May ever recorded, trailing only May 2022. So, border “encounters” are not remaining low as DHS claims. The key difference is where these “encounters” are happening. In May 2023, there were 35,317 inadmissible aliens at ports of entry, the highest monthly level ever recorded and more than double the 16,766 inadmissible aliens in May 2022.

Since January, DHS has been allowing an average of over 29,000 inadmissible aliens each month. In comparison, the highest number of inadmissible aliens at ports of entry in a single month during the Trump administration was about 12,000.

Second, the southern border “encounters” data does not include the approximately 30,000 illegal aliens from Cuba, Haiti, Nicaragua, and Venezuela who are unlawfully being allowed into American communities each month under the parole authority of the DHS secretary. Immigration parole is meant to be a narrow authority for temporary admission based on urgent humanitarian reasons or significant public benefit. The current parole program does not satisfy any of the statutory criteria.

To find the parole data, one must visit CBP’s separate encounters data page on their website and perform data filters and calculations. According to the data for May 2023, 29,622 illegal aliens were allowed into the U.S. through international airports via the unlawful categorical parole program.

Third, the southern border “encounters” data does not account for “gotaways”—illegal aliens who successfully evade Border Patrol agents. While the official DHS border data has never included the number of gotaways, this population raises significant concerns for national security and public safety. These individuals go to great lengths to avoid Border Patrol at a time when it has never been easier for an illegal alien to enter American communities.

It’s important to remember that over the past 28 months, more than 220 known or suspected terrorists have been apprehended at the southern border. It is likely that there are more among the reported 60,000 gotaways in May.

When you combine the illegal aliens apprehended by Border Patrol, the inadmissible aliens at ports of entry, the categorical parole illegal aliens, and the gotaways, a different reality emerges. In May, a total of 294,183 illegal aliens unlawfully entered the U.S., averaging approximately 9,490 per day.

Almost all of these individuals have made their way into American communities because ICE is detaining a record-low number of illegal aliens under the current nationwide catch-and-release policy.

This crisis is a deliberate creation. The American people deserve transparency, and it is crucial for Congress to hold this administration accountable through proper oversight and defunding of these unlawful policies.
