Caster Semenya Granted Permission to Appeal Testosterone Limit for Female Athletes by Court

The European Court of Human Rights has ruled in favor of South African Olympic runner Caster Semenya, stating that she should be given another chance to challenge the requirement for female athletes with high natural testosterone levels to take medication to lower it. Semenya, a double Olympic 800m champion, had previously lost appeals to the Court of Arbitration for Sport and the Swiss Federal Tribunal. The ECHR ruled that her original appeal against World Athletics regulations had not been properly heard, citing a lack of sufficient institutional and procedural safeguards in Switzerland. While this ruling may allow Semenya to challenge the rules that have affected her career, there is still a possibility for the case to be referred to the Grand Chamber of the Court. World Athletics, however, stands by its rules and will encourage the Swiss Government to seek a review of the judgement. Semenya has hyperandrogenism, a medical condition characterized by high testosterone levels, which can impact muscle mass, strength, and endurance. The current rules require athletes with differences in sexual development to lower their testosterone levels to those of a “healthy woman with ovaries” in order to compete in women’s events. Despite Semenya’s success in the sport, winning gold at the 2016 Olympics and being a three-time world champion, the expanding regulations have prevented her from running longer distances and continuing her career.
