40-Year-Old Man Accused in 2008 Palm Springs Financial Killing Faces Retrial

During opening statements in the retrial of a 40-year-old man accused of killing a Palm Springs retiree in 2008, a prosecutor asserted that the defendant had a desperate desire for money and devised a plan to commit murder and fraud. The defense attorney countered that his client is innocent because law enforcement failed to properly assess the evidence and instead fell into a biased trap.

The accused, Daniel Garcia, is facing multiple charges including murder, conspiracy, identity theft, and using forged documents. He also faces burglary, theft, and receiving stolen property charges. The murder charge includes a special circumstance of committing the crime for financial gain.

Garcia and his co-defendant, Kaushal Niroula, were initially convicted in 2012 for the murder of Clifford Lambert but were granted new trials due to the judge’s behavior. Niroula was later killed in a detention center.

Two other co-defendants, Miguel Bustamante and David Replogle, were initially convicted in 2011 but appealed their verdicts based on successful appeals by Garcia and Niroula. They were once again convicted but are awaiting sentencing.

Two more co-defendants, Russell Manning (now deceased) and Craig McCarthy (pleaded guilty in 2010), were involved in the alleged scheme.

The prosecutor, Robert Hightower, presented evidence that the defendants conspired to take advantage of and kill Clifford Lambert for financial gain. Garcia met Lambert on an online dating site while living in Sacramento. Hightower argued that Garcia, driven by greed and rejection, enlisted Niroula to assist in the murder and fraud.

Hightower detailed a timeline of events from Garcia and Lambert’s online meeting to Garcia’s arrest. Lambert rejected Garcia’s proposal to invest in his business idea, prompting Garcia to obtain Lambert’s personal information, including credit card details. In November 2008, Replogle and Niroula allegedly recruited Manning to pose as Lambert. In early December 2008, Niroula pretended to be an attorney and set up meetings with Lambert. Bustamante and McCarthy broke into Lambert’s home but did not follow through with the plan. On the following day, Garcia let Bustamante and McCarthy into Lambert’s home, resulting in Lambert’s murder. His body was wrapped in a rug, placed in the trunk of his car, and abandoned near San Francisco.

Hightower mentioned that some of Lambert’s remains were found in subsequent years. However, Jones, Garcia’s defense attorney, argued that the evidence would show Garcia’s innocence and his victimhood to confirmation bias. Jones claimed that law enforcement relied on unreliable evidence and wrongly accused Garcia. He asserted that incriminating documents were uploaded to Garcia’s devices shortly before his arrest.

In conclusion, the retrial seeks to determine the culpability of Daniel Garcia in the murder and fraud scheme targeting Clifford Lambert, with the defense arguing that Garcia was falsely accused due to confirmation bias, while the prosecution emphasizes Garcia’s alleged desperate need for money.
