Biden Administration Plans to Challenge Order Limiting Communication with Social Media Firms

The Justice Department has formally lodged an appeal against a federal court ruling that limits the ability of Biden administration officials to communicate with social media companies. The ruling, handed down by U.S. District Judge Terry Doughty, prevents administration officials from contacting these companies about the removal or suppression of protected free speech content on social media platforms. This decision comes after two Republican attorneys general accused the administration of engaging in censorship and colluding with social media platforms to target specific speakers and content. As a result, several government agencies, including the FBI, DOJ, Department of Health and Human Services, CDC, and State Department, were instructed to halt relevant communications with social media companies. White House Press Secretary Karine Jean-Pierre expressed the administration’s disagreement with the court’s decision during a briefing. The Department of Justice’s appeal will be heard by the 5th Circuit Court of Appeals in New Orleans, which is primarily composed of GOP-appointed judges. The agency also intends to request a stay on the district court’s ruling.
