Engaging conversations often arise when discussing universally known topics like “Disney.” However, probate court, a less popular subject, tends to elicit a glazed-over reaction from most people. My personal experience with probate court has acquainted me with its complexities.

In a decade-long legal battle, my son, Brad Disney Lund, the grandson of the legendary Walt Disney, has been embroiled in a protracted probate case. While Brad was successful in Arizona, our journey through the probate system revealed a level of malice that rivals the plots of fiction novels. Shockingly, cases of physical, psychological, and sexual abuse, as well as financial exploitation, are prevalent and well-documented by the Department of Justice.

These real-life instances raise pressing questions about the fairness of our legal system and the questionable legality of certain actions.

A recent story highlights the case of a New York landlord becoming the legal guardian of a 93-year-old Holocaust survivor who had no one else. Situations like these are not isolated incidents; they represent patterns of abuse within the probate system. Instances of physical abandonments, financial exploitation, and deprivation of due process are all too common and can be easily found through simple internet searches.

Witnessing individuals being denied their rights, stripped of their pensions, separated from their loved ones, coerced into declining health, and even left to develop bedsores due to neglect, inspired me to advocate for change.

Fortunately, there are legislative solutions in progress in the Arizona state legislature. The bills SB1291 and SB1038 enjoy bipartisan support and offer critical remedies. It’s essential that these bills become law as they address issues that affect not only the wealthy or elderly, but anyone caught in the web of probate.

In Arizona, without these protections, a nurse or physician’s assistant could exert control over an individual through a court order, potentially excluding their trusted personal physician. Our current reality is reminiscent of a dystopian society, where families are legally forbidden from visiting their loved ones, sedation is used to keep them “calm,” assets are liquidated, and personal belongings are sold. Wardens are charged for every aspect of care, including opening junk mail, eroding their basic rights like voting, driving, and choosing their own doctor. Essentially, all decision-making power is surrendered to a court-appointed guardian, someone who is often a stranger to the individual.

Probate cases can arise for reasons as trivial as a bank account problem or as complex as a family dispute over caregiving. The lack of oversight in the system means that individual civil rights can be easily violated, leaving their lives completely out of their control.

The sheer amount of money flowing through the probate system creates an environment that is susceptible to corruption. In the United States alone, there are approximately 1.3 million probate cases managing $50 billion, with $16.9 billion drained from the retirement accounts, family trusts, and lifetime savings of baby boomers. Shockingly, much of these funds end up in the hands of court-appointed players, aptly dubbed “probate pirates,” who skillfully liquidate assets while operating in the gray area of legality.

The legislation currently being voted on in Arizona this week offers hope for redressing these issues by establishing firm and unwavering protections for individuals’ rights. It is a necessary fight to put an end to the abuses taking place within the probate system.
