South Dakota has established itself as the leading state in terms of Second Amendment rights for several years. We prioritize freedom and individual responsibility. Our Founding Fathers created a government that acknowledges our inherent rights, including the right to protect ourselves, our families, and our Freedoms.
Unfortunately, not everyone respects the Second Amendment rights of all Americans.
Recently, Democrat Governor Michelle Lujan Grisham of New Mexico issued an emergency order that suspended the right to carry guns in Albuquerque and Bernalillo County for a minimum of 30 days.
Lujan Grisham classified this restriction on Second Amendment rights as an emergency public health measure, citing a threshold for violent crimes that was only reached in the Albuquerque area. The ban covered both open and concealed carry in almost all public spaces. Violations of the ban would result in civil penalties and fines of up to $5,000.
This is a tyrannical and unconstitutional act – and a federal judge agrees. A U.S. District Judge has blocked the part of the public health order that infringes on the Second Amendment.

When politicians exceed their authority during a crisis, we risk losing our country. That’s exactly what happened in New Mexico. If our nation follows this path, we will lose the rights and Freedoms that our Founding Fathers fought and died for.
In contrast to many other states, South Dakota is a sanctuary for Second Amendment rights. In fact, the first bill I signed into law as Governor ensures Constitutional Carry for all law-abiding South Dakotans. We became the first state to eliminate concealed carry permit fees, and we strengthened our “Stand Your Ground” laws. We even have legislation in place that prevents exactly what Lujan Grisham attempted in New Mexico. In South Dakota, state and local governments cannot use an emergency declaration as an excuse to infringe on Second Amendment rights.
LEGAL GUN OWNERS TAKE TO THE STREETS IN PROTEST OF NM GOVERNOR’S PUBLIC HEALTH ORDER
In April, I signed an Executive Order onstage at the National Rifle Association’s Institute for Legislative Action Leadership Forum. This Executive Order safeguards South Dakota’s Second Amendment rights from discrimination by financial institutions. The order prohibits state agencies from contracting with large banks that engage in discriminatory practices against firearm-related industries.
The United States Constitution may not always use straightforward language, but it is clear when it comes to the right to self-defense. “The right of the people to keep and bear arms shall not be infringed.”
The Second Amendment couldn’t be any clearer.
In Federalist Paper 46, James Madison writes, “ultimate authority, wherever the derivative may be found, resides in the people alone.” This concept is more simply expressed in our state motto: “Under God, the People Rule.” It’s time for liberal politicians to acknowledge that their actions are not only unconstitutional, but they also violate the ultimate authority of the people, which our founders clearly outlined.
