In a surprising turn of events, a Tennessee judge has announced the termination of the conservatorship agreement between former NFL player Michael Oher and the Memphis couple who took him in during his high school years. However, the highly publicized dispute involving financial matters will persist. Shelby County Probate Court Judge Kathleen Gomes declared the end of the 2004 agreement, which granted Sean and Leigh Anne Tuohy control over Oher’s finances. Oher signed this agreement at the age of 18 while residing with the couple who were nurturing his athletic talents. It is important to note that their remarkable story inspired the movie The Blind Side, which earned Sandra Bullock an Oscar for her stellar performance.
Oher, now 37, recently requested a financial accounting from the Tuohys, suspecting that they have benefitted from his name, image, and likeness, thus dishonestly misrepresenting the agreement as an adoption. In Tennessee, a conservatorship is typically reserved for individuals with medical conditions or disabilities who require assistance in decision-making. However, in Oher’s case, the conservatorship was mistakenly authorized despite his lack of diagnosed physical or psychological disabilities, as stated in his petition.
Judge Gomes expressed her dismay at the fact that such an agreement was ever formed, emphasizing that throughout her 43-year career, she had never encountered a conservatorship arrangement involving a non-disabled individual. “I cannot believe it got done,” she remarked. Oher and the Tuohys were present via video conference but did not participate in verbal exchanges. Both parties’ lawyers agreed that the agreement should be terminated, while the case will continue to address Oher’s allegations.
