Statute of Limitations Issues Uncovered in Lawsuit Against `Scrubs’ Writer, Judge Rules

A judge has ruled that one of the multiple women who have made civil suit sexual allegations against “Scrubs” writer and producer Eric Weinberg will need to strengthen her lawsuit in order for it to proceed. The ruling was made by Los Angeles Superior Court Judge Cherol J. Nellon, who heard arguments on April 19 regarding a motion by the defense to dismiss the case. The judge has given the plaintiff’s lawyers 30 days to file an amended lawsuit, stating that the current complaint lacks sufficient details on how the case does not violate the statute of limitations, considering that the allegations date back to 1998.

The plaintiff’s attorneys contended that the claims were “revived” by the Sexual Abuse and Cover Up Accountability Act, which allows for the revival of claims seeking damages from sexual assault with specific allegations. However, the judge stated that the complaint needs further clarification and does not meet the requirements for revival.
