Daniel Penny has been indicted by a grand jury in connection with the fatal chokehold death of Jordan Neely, a street performer, on a New York City subway, as reported by ABC News on Wednesday.
Last month, Daniel Penny, a 24-year-old US Marine veteran, was arrested and charged with second-degree manslaughter in relation to the death of Jordan Neely.
Sources have disclosed that the specific charges against Daniel Penny remain sealed. However, this recent indictment was an expected procedural step to proceed with the criminal case.
Daniel Penny was charged by Manhattan prosecutors for the May 1 death of Jordan Neely, who was a former Michael Jackson impersonator and had been struggling with homelessness and mental illness.
Due to the secrecy of grand jury proceedings, spokespeople for Manhattan District Attorney Alvin Bragg declined to comment on Wednesday. Nevertheless, New York City Mayor Eric Adams confirmed the indictment.
In a statement, Mayor Adams said, “I appreciate DA Bragg conducting a thorough investigation into the death of Jordan Neely. Like I said when the DA first brought charges, I have the utmost faith in the judicial process, and now that the Grand Jury has indicted Daniel Penny, a trial and justice can move forward.”
Jordan Neely was shouting at passengers and asking for money when Daniel Penny, along with two other riders, restrained him on the floor of the moving subway car. Penny, a former U.S. Marine, held Neely in a chokehold for over three minutes.
Penny claims that he was protecting himself and the other passengers, alleging that Neely threatened to kill him and was willing to go to jail for life. However, a freelance journalist who recorded the incident stated that Neely was acting aggressively but hadn’t physically assaulted anyone. It is important to note that Jordan Neely was Black, while Daniel Penny is white.
No immediate response has been received from Penny’s lawyers regarding these recent developments.
Neely’s death sparked protests, but there are individuals, including several Republican presidential candidates, who have shown support for Daniel Penny.
Penny, aged 24, was released on $100,000 bond following his arraignment on May 12. He will need to return to court to be arraigned on the new indictment.
According to New York law, a grand jury indictment was necessary for the case to proceed. If convicted, Daniel Penny could potentially face several years in prison.
