Donald Trump has requested the dismissal of his election interference indictment, citing his presidential immunity as a protective shield against prosecution. Trump’s legal team argued that the charges stem from actions he undertook in the course of his official duties as the President of the United States. Therefore, they asserted that he is “absolutely immune from prosecution.” The defense filed a 52-page motion urging the U.S. District Court in Washington to dismiss the conspiracy case.

The former president is facing four criminal counts linked to his efforts to overturn the 2020 election results and claim victory over President Joe Biden. Trump spent considerable time spreading baseless allegations of election fraud and attempting to convince Republican lawmakers, including his then-Vice President Mike Pence, to reject Electoral College votes in Biden’s favor during the congressional confirmation of the election results on January 6, 2021. The indictment suggests that in the aftermath of the violent attack on the U.S. Capitol by his supporters, Trump sought to manipulate the chaos to persuade GOP lawmakers to delay the certification of Biden’s win.

Trump has entered a plea of not guilty in this particular case, which is being prosecuted by special counsel Jack Smith. In addition to this ongoing legal battle, Trump is facing three other criminal cases as he actively pursues the 2024 Republican presidential nomination. One of those cases involves an alleged racketeering conspiracy with 18 co-defendants to reverse his defeat in Georgia by Biden in the 2020 election. Another case, in Florida federal court, accuses Trump of crimes related to the unauthorized retention of classified documents after leaving the White House and attempting to conceal them from government officials. Finally, in a New York state court, Trump is facing charges of falsifying business records in connection with a hush money payment made to adult film actress Stormy Daniels in 2016.
