A $3.5 million settlement has been approved by a judge between the Los Angeles Unified School District and a former special needs student. The student, referred to as John Doe, filed a lawsuit against the district and teacher’s aide Alex Salas, alleging negligent supervision and retention. The plaintiff dropped Salas as a defendant during the proceedings.
The settlement was reached during jury selection in January and was recently approved by the judge on behalf of the plaintiff, who is now 20 years old and has a disability. The plaintiff will receive just over $2 million after deducting attorneys’ fees and expenses, which will be placed in a special trust.
According to previous court papers, the plaintiff’s lawyers stated that Doe “will continue to suffer emotional distress damages.” The school district argued that no administrator or supervisor knew about Salas’ alleged abuse and that they had taken measures to prevent such conduct.
The plaintiff attended Grant High School, where Salas was assigned as a special education assistant. Salas accompanied Doe to and from school on a bus and was responsible for assisting him during that time.
The suit alleges that Salas groomed and manipulated the plaintiff, touching him inappropriately and making flirtatious advances. Salas also provided rides in his personal vehicle, where he continued to touch the plaintiff inappropriately and engaged in other abusive behavior.
The alleged grooming and manipulation culminated in Salas taking the plaintiff to a motel on multiple occasions, where he provided alcohol and then sexually abused him.
