Los Angeles County attorneys will seek approval from the Board of Supervisors on Tuesday for a substantial settlement of approximately $2.6 million with a fire department captain who was injured in a tragic incident at the Agua Dulce station. The incident involved a fellow firefighter who fatally shot another colleague.
In January of last year, Capt. Arnoldo V. Sandoval filed a lawsuit against the county, alleging assault, battery, and negligence as a result of the shooting that occurred on June 1, 2021. According to Sandoval’s lawsuit, he suffered severe injuries, including paralysis.
The lawsuit also named Jonathan Patrick Tatone’s estate, the gunman who opened fire at Station 81. Tatone killed 44-year-old Firefighter Engineer Tory Carlon, and Sandoval was wounded in the process. The suit claims that Tatone, who was off-duty at the time, arrived at the station and engaged in an argument before shooting Sandoval and Carlon. After the shooting, Tatone returned to his Acton home, set it on fire, and then took his own life.
In the lawsuit, Sandoval alleged that Tatone had exhibited threatening, bullying, combative, angry, and unstable behavior, all of which was known to his supervisors for years leading up to the shooting.
During their regular Tuesday meeting, the county Board of Supervisors will review a proposed settlement of $2.575 million with Sandoval. County Counsel Dawyn R. Harrison sent a letter to the board, stating that this case involves an employment-related lawsuit filed by a fire department employee who was shot and seriously injured during the Fire Station 81 incident.
Harrison further explained, “This proposed settlement is recommended due to the risks and uncertainties of litigation, and resolution at this time would avoid further litigation costs.”
