Teacher Accused of Sexually Abusing Student Faces Lawsuit Filed by LAUSD

The Los Angeles Unified School District is facing a lawsuit from an adult woman who claims she was sexually abused by her high school English teacher. In response, the district has filed a legal action against the same teacher, seeking a fair split of fault if found guilty.

The woman, referred to as Jane Doe, filed her lawsuit in April 2021 against both the district and her former teacher, Barry Smolin. However, Doe’s attorneys dropped Smolin as a defendant in July, and the trial against the LAUSD is scheduled for September 12.

Now, the LAUSD has taken legal action against Smolin, requesting a proportionate distribution of fault between the district and the teacher. Their lawyers state in the complaint that it is necessary to determine and allocate the degree of fault held by Smolin, with the district entitled to equitable contribution from him.

A representative for Smolin could not be reached for immediate comment.

According to Doe’s lawsuit, Smolin allegedly began grooming her during her freshman year at Hamilton High School in 2006-07 by giving her a CD of his own music. The grooming continued through her sophomore and junior years, and the sexual abuse started during her senior year in the 2009-10 school year.

The lawsuit states, “In fact, on one occasion while Smolin was sexually abusing plaintiff, another teacher walked in and Smolin literally threw plaintiff off of him and onto the seat next to him.”

Doe’s suit also alleges that Smolin provided her with alcohol and drugs, including marijuana and salvia, to manipulate her into maintaining an inappropriate relationship with him. Additionally, he allegedly gave her $300 to buy LSD, suggesting she could sell it for a profit. The suit claims that Doe has suffered humiliation and emotional distress as a result of these alleged abuses.
