Opinion | Mitch McConnell’s Hollow Rhetoric on the Legitimacy of the Supreme Court

Comment on this story: I found Senate Minority Leader Mitch McConnell’s op-ed on the Supreme Court to be interesting. While he presented data points to emphasize the Court’s moderation, there are clear themes that even the average person can see in recent decisions. Many of these decisions have overturned settled law, and it’s troubling to see minority protections being abandoned in favor of conflicting rights. Additionally, the aggressive use of the “major questions doctrine” raises concerns about the Court’s approach to important issues. I appreciate McConnell’s perspective, but I remain skeptical. – Janet Kinzer, Silver Spring

Ruth Marcus: McConnell built a conservative Supreme Court. Why doesn’t he want you to know?: Senate Minority Leader Mitch McConnell has manipulated the constitutional process to stack the Supreme Court with Federalist Society ideologues. This has resulted in a court that will lean to the right for decades. In his recent op-ed, McConnell used manipulated statistics to hide the Court’s conservative bias and claimed that it is ideologically unpredictable. This is simply not true. The Court has shown its ideological leanings in key cases, disregarding precedent and showing unprincipled hypocrisy. McConnell’s attempt to sell a different narrative is unconvincing. – Kamil Ismail, Ellicott City

In his op-ed, Mitch McConnell claims that fidelity to the Constitution means checking ideology at the door. However, he conveniently forgets his own actions, such as blocking Merrick Garland’s nomination and rushing Amy Coney Barrett’s appointment, which clearly demonstrate his own partisan motives. While the statistics presented in the op-ed are interesting, McConnell’s use of inflammatory language and partisan jabs undermines his argument. It’s hypocritical for McConnell to decry partisanship while engaging in it himself. – Anonymous

Mitch McConnell argues that neither party should count on the Supreme Court for advancing a partisan political agenda. I agree with this sentiment. However, McConnell’s own actions show that he is responsible for the current right-wing majority on the Court. He broke with tradition to fill two Supreme Court seats, ensuring that conservative justices would be appointed. McConnell’s strategy of presenting moderate cases to justify right-wing activism in others is transparent and serves the interests of his party’s funders. These decisions are an assault on American freedoms and undermine long-standing precedent. Most Americans can see through McConnell’s attempts to hide the partisanship of the Court. – Edward J. Markey, Washington
