Kevin Costner’s estranged wife has responded to the actor’s claims that she refuses to leave their marital home.
In a court document obtained by Insider, Christine Baumgartner’s lawyer, John Rydell, argued that Costner has no legal basis for attempting to evict her and their children from the only home they’ve ever known.
“This request for order seeks to remove Christine and their three children from the house they have lived in their entire lives,” Rydell stated. He added that while there is little legal justification for Costner’s request, it remains a matter of great importance for Baumgartner.
These comments were made in a court filing on June 14, where Rydell criticized Costner’s attorney, Laura Wasser, for refusing to postpone a hearing to decide whether Baumgartner can continue living in Costner’s $145 million compound off the Santa Barbara Coast.
Rydell and Wasser were contacted for comment but did not respond immediately.
In recent reports, Kevin Costner raised concerns with the judge overseeing their divorce case that Baumgartner refused to vacate the compound as stipulated in their premarital agreement.
“After my previous divorce, I found myself without a home and unable to live in my own property,” said Costner in a court declaration from June 8. “I did not want to experience that again. Due to the nature of my work, I frequently travel, so it is crucial to me that I have a home to return to when I am not on set.”
“Therefore, when Christine and I discussed getting married in 2003, I made it clear that I would not remarry unless it was clear that my separate properties would always be mine to live in, regardless of what happened in our marriage,” Costner added in court documents.
According to court papers, Costner offered Baumgartner $1 million toward a new home and agreed to cover her mortgage, insurance, and taxes for a year on the new property.
Costner also expressed his desire for joint custody of their three children: Grace, 13, Hayes, 14, and Cayden, 16. He stated that their mother’s eviction would not significantly impact the children.
“Since the children will spend at least half of their time at my home, they will not be affected by Christine’s imminent move,” Costner stated in his June 8 declaration. “Christine and I have been working on a summer schedule to ensure the children have a smooth transition between our two homes.”
A ruling on postponing the hearing or banning Baumgartner from Costner’s compound has not yet been made by the judge.
The couple, who have a 19-year age difference, met in the early 1990s on a golf course when Costner was preparing for his role in the film “Tin Cup.” At the time, Costner was still married to his first wife, Cindy Silva.
Costner’s costly divorce from Silva, in which she was awarded an estimated $80 million, influenced him to have a strict premarital agreement in his second marriage, according to Forbes.
After their initial meeting, Costner and Baumgartner began dating in 1998 and got married in 2004 at Costner’s expansive 165-acre ranch near Aspen, Colorado.
In addition to the divorce proceedings, Costner is also facing drama in his professional life. Deadline reported in February that a behind-the-scenes feud between Costner and “Yellowstone” cocreator Taylor Sheridan was causing delays in production for the show’s fifth season. It was announced in May that the fifth season would be the final season of the drama.
