A judge has ruled that one of the multiple women who have made civil suit sexual allegations against “Scrubs” writer and producer Eric Weinberg will need to strengthen her lawsuit in order for it to proceed. The ruling was made by Los Angeles Superior Court Judge Cherol J. Nellon, who heard arguments on April 19 regarding a motion by the defense to dismiss the case. The judge has given the plaintiff’s lawyers 30 days to file an amended lawsuit, stating that the current complaint lacks sufficient details on how the case does not violate the statute of limitations, considering that the allegations date back to 1998.
The plaintiff’s attorneys contended that the claims were “revived” by the Sexual Abuse and Cover Up Accountability Act, which allows for the revival of claims seeking damages from sexual assault with specific allegations. However, the judge stated that the complaint needs further clarification and does not meet the requirements for revival.
The judge wrote, “As currently pleaded, the plaintiff’s complaint lacks the necessary facts for revival or estoppel to apply to her claims. The plaintiff must provide more than vague, conclusory statements.”
The plaintiff, I.J., alleges that Weinberg and his company engaged in a cover-up of previous instances of sexual assault by threatening victims. However, the judge noted that the complaint does not mention any specific instances or provide any discussion of a cover-up.
In her allegations, I.J. claims that Weinberg lured her to his residence in March 1998, where he sexually assaulted her. According to the lawsuit, Weinberg, who introduced himself as a Hollywood writer and photographer, had offered to take professional headshots for I.J. However, once alone, he disrobed, demanded that I.J. do the same, sexually abused her, and then forced her to pose nude for outdoor photographs. He threatened to harm her and her child if she ever told anyone about the incident.
I.J. also alleges that Guitar and Pen Productions, Inc. aided and abetted Weinberg’s abuses.
Weinberg, 62, is facing criminal charges related to multiple women. His other credits include shows like “Politically Incorrect with Bill Maher,” “Californication,” and “American Dad.”
